    Not necessarily. It could be the GND solder pad, so it's normal for there to be a connection to the surrounding copper layer. Look at the solder pad marked in red. There are small bridges (like spokes) connecting the solder point to the copper (called thermal reliefs). Take a good look around...

    The MMBF5458 is generally unavailable, but the Mouser website offers suggestions for similar transistors. For example, the 2SK932 (datasheet) or MMBF4117 (datasheet) Any experience with them? There is also TF412S but the SOT-833 package rather discourages its use.
